Wofford Community Expectations
Sexual misconduct and sexual harassment are forms of discrimination. Wofford College strongly urges all members of the campus community to play a role in discouraging, responding to, and preventing sexual misconduct. Wofford College encourages the community to speak up when an incident occurs and to report sexual misconduct. The College is committed to eliminating sexual violence and other abusive behavior, preventing the recurrence of these behaviors, and addressing the effects through support and resources.

Sexual Misconduct Policy and Reporting Options
Further, any individual who feels that he or she has been subjected to sexual misconduct is encouraged to seek assistance and resolution. Wofford’s sexual misconduct policy provides a variety of ways in which an individual may proceed in cases of unlawful discrimination, sexual harassment, sexual misconduct, and retaliation, so that each individual may chose an avenue for reporting appropriate to his or her particular situation, whether that be internally through Wofford College informal or formal resolution or externally through law enforcement or criminal or civil processes.

What is Title IX?

Title IX refers to Title IX of the Educational Amendments Act of 1972, which amended the Civil Rights Act of 1964, and provides:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” 20 USC 1681.”

Why does Title IX apply to situations involving sexual misconduct?

Sexual harassment, which includes sexual violence and other forms of nonconsensual sexual misconduct, is a form of sex discrimination and therefore is prohibited by Title IX.

How and where can I file a complaint?
Complaints should be filed with the Title IX Coordinator or Deputy Coordinator of the complainant’s choice. The complainant may be a student, faculty member, staff member or visitor to campus. The Title IX Coordinator has responsibility for overseeing the College’s compliance with Title IX, including complaints of sexual misconduct. All instances of sexual misconduct should be reported to the Title IX Coordinator or a Title IX Deputy coordinator.

Are victims/survivors forced to share their experience with the College or pressured to pursue disciplinary action?

No. The victim/survivor of sexual misconduct always retains control over who to talk to and what level of information to share. We will never force a victim/survivor to share the details of their experience, but when a report of sexual misconduct is shared with a Responsible Employee of the College, we have a legal duty to follow up on the report to determine the appropriate response under Title IX. The Title IX Coordinator will conduct an initial assessment regarding, among other things, the nature of the report, the safety of the individual and of the broader campus community, and the complainant’s expressed preference for resolution. Students are not pressured to pursue a specific action. In planning any response, the wishes of the Complainant are given full consideration. In limited circumstances, the College may need to pursue an investigation and disciplinary proceeding against the wishes of the Complainant, but usually only if there is a broader safety risk for the community. A Complainant will not be forced to participate in any such investigation or proceeding.

Will people involved in the Title IX process be sensitive to the needs of victims/survivors?

The Title IX staff complete annual training and intentionally work to create a compassionate, sensitive environment to address the issues, offer an unbiased and transparent system for gathering facts, and connect all community members with appropriate support and resources.

What if I am concerned about retaliation?
Wofford’s Sexual Misconduct Policy strictly prohibits retaliation against any person for filing, supporting, or providing information in good faith in connection with a complaint of sexual misconduct. Retaliation is any adverse action threatened or taken against a person because he or she has filed, supported, or provided information in connection with a complaint of sexual misconduct. This includes direct and indirect intimidation, threats, harassment and other behavior. Any person who feels that he or she has been subjected to retaliation should make a report to the Assigned Title IX Deputy Coordinator or to the Title IX Coordinator.

Resources and Options:

If you have experienced a sexual assault or violence in a dating or intimate relationship, the most important thing you can do is get to a safe place. If you believe you or anyone else is in immediate danger, call 911 as soon as possible.

Once you are safe, contact someone you trust to be with you for support. This could be a friend, family member, or someone on campus. Safe Homes Rape Crisis Coalition has confidential advocates available through a 24-hour crisis line at 800-273-5066.

Medical Care:

No matter what happened, you should seek medical attention as soon as you can—even if you’re not sure whether you want to report the incident. It’s the best way to protect yourself from the risk of sexually transmitted diseases and pregnancy in connection with a sexual assault. And even if you think you are physically okay, you may have injuries that need treatment. It’s also important to have a forensic exam done. This ensures that evidence gets collected in case you decide to report what happened.

Sexual Assault Forensic Exam-Preserve Evidence of the Sexual Violence or Encounter:

You can go to Spartanburg Medical Center or Mary Black Hospital to request a sexual assault forensic exam (often called a “rape kit”) within 72 hours of the assault. Even if you have not decided whether to file charges, it is advisable to have the evidence collection kit completed so that you can better preserve the options of obtaining a protective order and/or filing criminal charges at a later date. If you do not wish to file a report with law enforcement at this time, you may request an anonymous kit with no law enforcement involvement. Spartanburg Medical Center has specially trained sexual assault nurse examiners who perform these kits. The cost of these kits will be paid for from a crime victim fund, and you will not be billed for the kits.

While you might be tempted to try to erase all signs of what happened to you, it’s important to preserve the evidence. If you plan to have a sexual assault forensic exam done, do not do any of the following things until you have gotten medical attention and/or contacted the police:

  • Bathe or shower
  • Use the restroom
  • Eat or drink
  • Change clothes
  • Comb hair
  • Clean up the crime scene
  • Move anything the offender may have touched


Get Counseling and Support:

Coping with the aftermath of a sexual assault or dating or domestic violence can be very difficult—but remember, you’re not alone. Wofford offers counseling services to help you recover. Make it a priority to get the help you need to process what happened to you and recover from the incident.

Consider Reporting the Incident

Deciding whether or not to report an incident isn’t easy. Feel free to take your time with the decision (but make sure to get medical attention to collect evidence). If you decide to report the event, you have several options. You can:

· Report it to campus police or local law enforcement
· File a complaint with the Title IX Coordinator
· Report to both law enforcement and the Title IX Coordinator
If you do report the event to the Title IX Coordinator, you can ask the Title IX Coordinator to help you notify law enforcement. You can also decline to involve the police.
